Judge challenges outdated family court ruling

A High Court judge has overturned a family court decision that dismissed allegations of domestic abuse as “largely historical. ”

The mother reported multiple incidents, including rape and threats, while the father disputes these claims and seeks more time with the children.

During the appeal, counsel for the mother, Alex Laing, argued that the court’s conclusion was unacceptable.

The judge, Mr Justice Garrido KC, ordered a factfinding hearing, emphasising the need to assess potential risks to the children.

A report revealed that domestic abuse is involved in 87% of family court cases but only considered in 42% of hearings.
