Edward Hess, the deputy national lead judge of the financial remedies court, has warned that proposed changes could increase court cases by 30%.
He estimated an additional 10,000 break up cases annually, raising the total eligible couples for financial claims to 16.5m. The rights of cohabiting couples following a review of separation does need addressing and is long overdue, but the family courts are already struggling with a backlog of cases.
